1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern your use of the Cuppd website at cuppd.coffee and the Cuppd mobile application (together, the “Platform”), operated by [LEGAL ENTITY NAME] (company number [COMPANY NUMBER]), registered in England and Wales at [REGISTERED ADDRESS] (“Cuppd”, “we”, “us”, or “our”).

By accessing or using the Platform — including joining the waitlist, creating an account, or submitting a roastery enquiry — you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. The Cuppd Platform

2.1 What Cuppd Is

Cuppd is a specialty coffee discovery platform. The Platform currently comprises:

• The Cuppd website at cuppd.coffee, including a consumer waitlist and a roastery enquiry form
• The Cuppd mobile application (in development)

Features and functionality will be added over time. These Terms will be updated before any material new feature is made available to users.

2.2 Service Availability

We aim to make the Platform available at all times but do not guarantee uninterrupted availability. We may carry out maintenance, make updates, or temporarily suspend access without notice. We are not liable for any loss caused by unavailability.

3. Waitlist

3.1 Joining the Waitlist

By submitting your email address via the waitlist form, you are requesting to be notified when Cuppd launches. Joining the waitlist does not create an account or guarantee access to any paid service.

3.2 Communications

By joining the waitlist, you agree to receive launch notification emails from Cuppd. You can unsubscribe at any time via the link in any email we send. We will not share your email address with third parties for marketing purposes.

3.3 Waitlist Data

Waitlist email addresses are stored in our database and mirrored to Klaviyo for email delivery. They are handled in accordance with our Privacy Policy.

4. Roastery Enquiries

4.1 Claim Form

Roasteries may submit an enquiry via the Roastery Pro page to request that their roastery profile be claimed or created on the Platform. Submission does not guarantee a claimed profile or any commercial relationship with Cuppd.

4.2 Pre-Seeded Profiles

Cuppd may pre-seed the database with roastery profiles based on publicly available information. If you are a roastery and believe any information about you is inaccurate, contact us at hello@cuppd.coffee and we will correct it promptly.

4.3 Roastery Representative Warranty

By submitting a roastery claim enquiry, the submitting individual warrants they are authorised to act on behalf of the roastery named in the form.

5. Accounts

When account creation is available on the Platform, the following terms will apply.

5.1 Eligibility

You must be at least 13 years old to create an account.

5.2 Account Security

You are responsible for keeping your login credentials secure. Notify us immediately at hello@cuppd.coffee if you suspect unauthorised access to your account.

5.3 Accuracy

You agree to provide accurate, current, and complete information when creating your account and to keep it up to date.

6. Acceptable Use

You agree not to use the Platform to:

• Post false, misleading, or defamatory content
• Harass, threaten, abuse, or discriminate against any person or business
• Post spam, unsolicited promotions, or irrelevant commercial content
• Upload malware or anything designed to damage or interfere with the Platform
• Scrape, crawl, or extract data from the Platform by automated means without our written permission
• Impersonate another person, brand, or business
• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Platform or its backend systems

Violations may result in removal of submitted content, suspension of access, or permanent termination at our discretion.

7. Analytics and Advertising Technologies

We use the following third-party technologies on the Platform to understand how it is used and to improve it. Each is governed by the relevant provider's own terms:

8. Intellectual Property

If you submit feedback or suggestions about the Platform, we may use them freely without obligation to you.

9. Third-Party Links

The Platform may contain links to third-party websites, including roastery websites. These links are provided for convenience only. We have no control over third-party sites and are not responsible for their content, privacy practices, or availability.

10. Disclaimers

10.1 No Guarantee of Accuracy

While we take care to maintain accurate information, we do not guarantee the accuracy, completeness, or currency of any information on the Platform. Roastery details, coffee availability, and other third-party information may change without notice.

10.2 “As Is”

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential loss arising from your use of the Platform
• Our total liability to you for any claim arising from these Terms or your use of the Platform is limited to £100
• Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law

12. Changes to These Terms

We may update these Terms from time to time, including when new Platform features launch. We will display a notice on the website when Terms are updated. The “last updated” date at the top of this document reflects the most recent version.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of England and Wales.
